Writing Kit Courses

Please read these terms carefully before booking a course. By booking, you agree to be bound by them.
1. About us and these terms
1.1 We are WRITING KIT of 3 Pegasus House, Pegasus Court, Olympus Avenue, Warwick,
CV34 6LW(“we”, “us”, “our”). You can contact us at learn@kitdewaal.com
1.2 These terms apply to the writing courses we sell through kitdewaal.com (“our site”) and govern the contract between you (“you”, “your”) and us for any course you book (“Course”). They apply alongside our Privacy Policy, which explains how we handle your personal information.
1.3 We may update these terms from time to time. The version in force on the date you book your Course is the one that applies to that booking.
2. Booking and your contract with us
2.1 Our Courses are open only to people aged 18 or over. By booking, you confirm that you are at least 18 years old.
2.2 When you book and pay for a Course, we will send you a confirmation email. A legally binding contract between you and us is formed only when we send that confirmation email.
2.3 We may decline any booking before a Course starts, for any reason. If we do, we will promptly refund in full any fee you have paid.
2.4 Course descriptions on our site set out what each Course includes. By booking, you confirm you have read the description and consider the Course suitable for you. If you are unsure, please contact us before booking.
2.5 Your place is personal to you. You may not share, resell or transfer it to anyone else without our written agreement, though we will not unreasonably refuse a transfer request.
3. Payment
3.1 The price of each Course is as shown on our site at the time of booking and is quoted in UK
pounds sterling. The full fee is payable at the time of booking
3.3 If a Course is obviously mispriced on our site through error, and you could reasonably have
recognised the mistake, we may cancel the booking and refund what you have paid.
4. Cancellation by you, and refunds
4.1 To cancel your booking, email us at learn@kitdewaal.com. Your cancellation takes effect on the date we receive your email. You may use the cancellation form at the end of these terms, but you do not have to.
4.2 If you cancel more than 28 days before the Course start date, we will refund your fee in full. If you cancel between 14 - 28 days before the course start date, we will refund 50% of your fee. If you cancel 14 days or less before the course start date there will be no refund.
4.3 Under the Consumer Contracts Regulations 2013 you also have a legal right to cancel within 14 days of booking. If your Course starts within that 14-day period, you agree that we may begin
providing it before the period ends; if you then cancel within the 14 days, we may deduct an amount reflecting the part of the Course already provided.
4.4 It is not normally possible to defer your place to a later Course or transfer to another group,
though we may agree to this in exceptional circumstances at our discretion.
5. If we cancel or change a Course
5.1 If we have to cancel a Course before it starts, we will tell you as soon as we can and either offer you a place on an equivalent Course or refund your fee in full.
5.2 If we have to cancel an individual session, we will try to reschedule it or provide an equivalent session. If we cannot, we will offer a pro-rated refund for that session.
5.3 We may change the tutors or other personnel delivering a Course, and may update Course
materials to keep them current.
5.4 We are not responsible for failure or delay in delivering a Course caused by events outside our reasonable control, including illness, industrial action, epidemics, failure of telecommunications networks or internet services, or other circumstances we could not reasonably have foreseen or avoided. In such cases we will do what we reasonably can to reschedule or, where a Course or session cannot be delivered at all, refund fees for the part not delivered. We do not cover travel or other costs you may incur, and we recommend you do not book anything non-refundable in reliance on a Course taking place.
6. Online delivery
6.1 Our Courses are delivered online through live video sessions (currently via Zoom). You are
responsible for having the equipment, software and internet connection you need to take part, and for any costs of these.
6.2 Login links and any course materials we send you are for you alone. Please do not share them.
6.3 You may not record any session yourself, whether audio or video, or photograph or screenshot other participants’ work. This is to maintain the safety and confidentiality of the group.
6.4 If a session is disrupted by a technical failure at our end, we will rearrange it or provide the
material another way. We are not responsible for problems caused by your own equipment or
connection.
7. Conduct
7.1 Our Courses depend on generosity and trust between everyone taking part. You agree to treat tutors, guests, staff and fellow students with respect at all times, and to keep feedback on other students’ work considerate and constructive.
7.2 You must not bully, harass, intimidate or demean anyone, or share material that is unlawful or that a reasonable person would find abusive. Because writing courses explore difficult subjects, you may encounter work you find challenging or upsetting; if your own work contains sensitive content, please flag it before sharing.
7.3 You agree to participate fully and on time, including completing writing tasks so the Course runs smoothly for everyone.
7.4 If you seriously or repeatedly breach this section or any other part of these terms, we may
remove you from the Course without refund. We will only do this where we consider it necessary, and where practical we will raise our concerns with you first.
8. Your work: copyright, originality and AI
8.1 You own the copyright in everything you write. All work you produce before, during or after a Course remains yours. We claim no ownership of it and will never assert any rights over it. If we would like to quote your work or comments to promote our Courses, we will always ask your
permission first.
8.2 You promise that work you submit is your own and does not infringe anyone else’s copyright or other rights. This promise survives the end of the Course.
8.3 You must not present work generated wholly or substantially by AI tools (such as ChatGPT or similar) as your own writing, whether in an application, in workshops or in anything connected with a Course, without telling us.
8.4 You agree to keep confidential the work, ideas and plotlines other students share during a
Course, both during and after it, and not to copy, share or distribute anyone else’s work in any form.
9. Our course materials
9.1 All Course materials we provide, including notes, exercises, recordings, videos and handouts,
belong to us or our licensors and are protected by copyright.
9.2 You may use the materials for your own study during and after your Course, including printing single copies for personal use. You may not reproduce, publish, share, sell or distribute them in any form without our written permission.
10. What we do not promise
10.1 We will deliver your Course with reasonable skill and care, and we hope it will do great things for your writing. But writing and publishing are uncertain, and we make no promises about outcomes. In particular, taking a Course does not mean, and we do not guarantee, that you will be published, that you will secure a literary agent, that your writing will reach any particular standard, or that you will gain entry to any other course, prize or opportunity.
10.2 Feedback given by tutors, guests or other students is opinion offered in good faith. It is not
professional, publishing or legal advice, and any decisions you make based on it are your own.
11. Our liability to you
11.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or negligence. We are not responsible for loss that was not
foreseeable when the contract was made.
11.2 Our Courses are supplied for private use. We have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
11.3 Our total liability to you in connection with a Course will not exceed the fees you have paid us for that Course.
11.4 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be excluded. Nothing in these terms affects your statutory rights as a consumer, including your right to have services performed with reasonable skill and care. Advice about your legal rights is available from Citizens Advice.
12. Your responsibility to us (indemnity)
12.1 If we face a claim from someone else because work you submitted infringes their copyright or other rights, or because of your breach of these terms, you agree to compensate us for the losses, damages and reasonable legal costs we incur as a result. This obligation survives the end of your Course.
13. Your personal information
13.1 We use the personal information you give us to run your Course and administer your booking, as set out in our Privacy Policy on our site. Your name and the work you share will be visible to your tutor and fellow students as part of the Course; we will not share your contact details with other students.
14. General
14.1 If a court finds any part of these terms unenforceable, the rest remains in force.
14.2 If we do not immediately enforce a right under these terms, we can still enforce it later.
14.3 This contract is between you and us; no one else has rights under it. We may transfer our rights and obligations to another organisation, but this will not affect your rights.
14.4 These terms are governed by English law. You can bring legal proceedings in the courts of
England and Wales; if you live in Scotland or Northern Ireland, you may also bring proceedings there.
